在一起放火案中，红叶造纸厂的一个仓库被他人放火焚烧，直接经济损失达50万元。事后经查明，放火者是另一个造纸厂的厂长。案件经公安机关侦查终结后，移送人民检察院审查起诉，红叶造纸厂提出要委托诉讼代理人。人民检察院则说：公诉案件的被害人指的是自然人，不包括单位，因而法律上所说的“被害人及其法定代理人或者近亲属有权委托诉讼代理人”不能适用于红叶子造纸厂。如果红叶造纸厂确实要委托诉讼代理人，也只能提起附带民事诉讼，以附带民事诉讼原告人的身份委托诉讼代理人，并且要在人民法院受理案件之后才能委托诉讼代理人。无奈，红叶造纸厂只好提起了附带民事诉讼，并在案件起诉至人民法院后委托了在某监狱任职的作为诉讼代理人。在法院审判过程中，去人民法院查阅、复制案件有关材料，了解案情，人民法院没有准许。因此辞去了诉讼代理人的职务。红叶造纸厂要求另行委托诉讼代理人，被人民法院告知：只能在法庭开庭审理之前委托诉讼代理人，现在已进入了法庭审理中的阶段，因而红叶造纸厂不能再委托诉讼代理人了。人民法院最后作出了刑事和附带民事判决。 问： (1) 本案中，人民检察院的说法是否正确?
