Sheppard’s is a pub located in Illinois about five miles from the Missouri border. Sheppard’s advertises with a large billboard that is situated in Illinois, but only fifteen yards from the Missouri border. The billboard faces the Missouri side of the border so that it can easily be read by drivers in Missouri headed eastbound on Interstate 57 into Illinois. The billboard states: “ Come on over to Sheppard’s – Just Five More Miles on Interstate 57.” Sheppard’s also advertises in a local Illinois paper, Twain’s Economist, by inserting flyers into the paper. The flyers advertise that Sheppard’s has the “region’s best drink specials.” Twain’s Economist has a circulation mostly in Illinois, but the paper has a few subscribers in Missouri, including subscribers in a Missouri town where Osage State College is located. Sheppard’s does not engage in any other conduct in Missouri or anywhere else outside of Illinois. Thomas is an Osage State College student who travels to Sheppard’s pub, gets drunk, and causes an accident with Kim in Missouri on his way home. Thomas never saw any of Sheppard’s advertisements. But Thomas went to Sheppard’s because his college friends had heard of the pub, had seen the billboard, and had seen advertisements in an old copy of Twain’s Economist in a coffee shop on the Osage State College campus. Kim, a Missouri citizen, sues Sheppard’s in Missouri state court for negligently serving Thomas after he was obviously drunk. Sheppard’s moves to dismiss for lack of personal jurisdiction. Assume that Missouri’s long-arm statute reads as follows: “A court of this state may exercise jurisdiction on any basis not inconsistent with the Constitution of the United States.” Assume also that the courts of Missouri and of the Eighth Circuit Court of Appeals have not yet determined whether their courts should apply the “but for test” or “evidence test” of personal jurisdiction, so parties must argue both tests when making personal-jurisdiction motions.
